Special Circumstances:
- Obtaineda federal determination that the work did not trigger permits the agency’s permits.
- Obtained concurrence from the State of Hawaii that only County permits were necessary and a Conservation District Use Permit was not required given the scope and manner in which the seawall was being repaired.
- Obtained archival evidence of an existing state-certified shoreline that indicated there were no encroachments onto State property or jurisdiction.
